Terms of service
Last updated 5 November 2026
These terms govern your use of websites, apps and services supplied by ZESPY PTY LTD (ABN 32 677 942 488) ("Zespy", "we", "us"). Our services include products such as Lushie, ezPay, ezPlan, ezClaims and TruScan.
By creating an account or using a service, you agree to these terms. Product-specific information shown before you subscribe, purchase or confirm a paid operation also forms part of your agreement with us. If there is an inconsistency, the product-specific information applies to that product or transaction.
Accounts and authorised users
- You must provide accurate information and keep your sign-in details secure.
- You are responsible for activity performed through your account, except to the extent it results from our failure to take reasonable security measures.
- If an organisation provides your access, that organisation may manage your access and the information it controls in the service.
- Tell us promptly if you believe an account or credential has been used without permission.
Acceptable use
You must use our services lawfully and only for purposes you are authorised to perform. You must not:
- upload or process content you do not have the right to use;
- interfere with, probe or attempt to bypass the security or operation of a service;
- use a service to harm, deceive, harass or unlawfully discriminate against another person;
- use automated access in a way that unreasonably burdens a service or breaches a published interface limit;
- resell or misrepresent a service unless we have agreed to it in writing.
Your content and privacy
You keep ownership of content you submit. You give us the limited permission needed to host, process, transmit and display that content to provide, secure and support the service you requested. This permission ends when the content is deleted, subject to reasonable backup, legal and record-keeping requirements.
You are responsible for having any permissions or notices required to enter information about another person. Our handling of personal information is explained in our privacy policy.
Automated and AI-assisted services
Some services use automated systems or artificial intelligence to analyse information or create output. These systems can make mistakes. Review important output before relying on it, especially where it may affect a person, payment, claim, legal obligation, health or safety.
Unless a product expressly says otherwise, generated or extracted output is assistance rather than legal, medical, financial or other professional advice, and it does not replace checks required by you or your organisation.
Purchases, subscriptions and credits
- The price, currency, billing period and anything included in a purchase are shown before you confirm it.
- A subscription continues for the period shown at purchase and renews only as disclosed by the product or store. You can manage or cancel it using the method shown for that purchase.
- Credits are a prepaid entitlement to use eligible services. The product shows the credits required for a paid operation before you confirm it. Credits are not cash, but this does not limit any refund or remedy required by law.
- Purchases made through Google Play, Apple's App Store or another marketplace are also subject to that store's payment, cancellation and refund processes.
If a product or service is faulty, not as described or otherwise fails to meet a consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation or other remedy under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies rights that cannot lawfully be excluded.
Availability and changes
We work to keep our services available and secure, but maintenance, faults and events outside reasonable control can interrupt them. We may improve, replace or discontinue features. Where a change materially disadvantages a paid service, we will give reasonable notice where practicable and provide any cancellation, refund or other remedy required by law.
Our intellectual property
We and our licensors own the services, software, branding and other material we provide, excluding your content. We give you a limited, revocable, non-transferable right to use the services for their intended purpose while your access remains valid. Open-source components remain subject to their own licences.
Suspension and ending access
We may restrict or suspend access where reasonably necessary to protect people, data or the service, respond to unlawful use, or address a serious breach of these terms. Where appropriate, we will explain the issue and give you a reasonable opportunity to fix it. You may stop using a service at any time, subject to any billing or cancellation terms shown for your purchase.
Consumer rights and responsibility
Our services come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms limits liability or remedies where doing so would be unlawful. For other matters, each party is responsible for loss caused by its breach, negligence or unlawful conduct to the extent determined by applicable law.
General
These terms are governed by the laws of Queensland, Australia. If one part is unenforceable, the remaining parts continue. A delay in enforcing a right does not waive it.
We may update these terms to reflect service or legal changes. The current version and its date will appear on this page. Changes do not take away rights you already have, and material changes to a paid service will be notified where reasonably practicable.
